BY ATTENDING SUMO + SUSHI, YOU AGREE TO THE FOLLOWING:

WAIVER OF CLAIMS, RELEASE OF LIABILITY, MEDIA RELEASE, EXPRESS ASSUMPTION OF RISK, HOLD HARMLESS AND INDEMNIFICATION AGREEMENT

As consideration for being allowed to attend and/or participate in Sumo + Sushi (“Event”) hosted by Sounds Excursions, LLC, d/b/a SE Productions (“Organizer”), the undersigned (“Participant”), on his or her own behalf, acknowledges, understands, and agrees to the following terms and conditions contained in this Agreement (“Agreement”):

  1. 1.Participant represents that they are at least 21 years old and are legally competent to understand and complete this Agreement. Participant hereby executes this Agreement without coercion.

  1. 2.The possession or use of illegal drugs is strictly prohibited while attending and/or participating in the Event. All participants must be 21 years of age to consume alcohol and must do so responsibly. The excessive consumption of alcohol and all violent or inappropriate behavior will not be tolerated. If Participant exhibits such behavior, in Organizer’s sole and absolute discretion, Organizer may remove Participant from Event and no refund will be granted. Participant hereby acknowledges that Organizer is not responsible for guaranteeing appropriate behavior by other participants of the Event, and Participant hereby accepts all known and unknown risks associated with such behavior being exhibited by other participants at the Event.

  1. 3.Participant recognizes, acknowledges, agrees and understands that participation in the activity of Sumo Wrestling (“Activity”) is an active sport, which require strength, agility, and concentration and that it is solely Participant’s responsibility to determine if Participant is in the proper physical and mental condition required to participate in the Activity.

  1. 4.Participant recognizes, acknowledges, agrees and understands that participation in the Event and/or Activity can result in severe, permanent personal injuries, including, but not limited to, bruised, strained, sprained or torn muscles, tendons and ligaments, broken bones, derangements or dislocations of joints, concussion, brain damage, paralysis, emotional distress, and death. Participant further recognizes, acknowledges, agrees and understands that participation in the Activity may require the use equipment which may cause or contribute to severe, permanent personal injuries, such as those described above. Participant further recognizes, acknowledges, agrees, and understands that there are also unknown risks associated with participation in the Event and/or Activity, including but not limited to exposure to bacteria, fungus, viruses, unknown contagious diseases, and/or COVID-19.

  1. 5.Participant understands that the description of the risks in this Agreement is not complete and voluntarily choose to participate and expressly assume all risks and dangers and the damage and loss resulting therefrom, whether or not described here, known or unknown, inherent or otherwise. Participant also willingly assumes all known and unknown risks associated with participation in the Event and/or Activity and the risks that may arise due to other participants. Participant also willingly assumes that subsequent to the execution of this Agreement, Participant may incur or suffer personal or bodily discomfort, loss, injury, disability, death, damage, or property damage which are in some way caused by or related to participation in the Event and/or Activity; even in circumstance including but not limited to misconduct or negligence and Participant fully understands that the previously stated risk conditions could become more serious than expected or anticipated.

  1. 6.Participant agrees to comply with all safety rules and verbal instructions of Organizer personnel as conditions for participation in the Event and/or Activity. Participant acknowledges that participation in the Event and/or Activity may be denied if Participant evidences any symptoms of excessive intoxication, sickness or illness, including, without limitation, symptoms of exposure to bacteria, fungus, viruses, unknown contagious diseases, or COVID-19 or any other condition(s) that Organizer Personnel, in their sole discretion, deem to make participation unsafe.

  1. 7.Participant, for his/her self and Participant’s heirs, assigns, representatives, family members, estates, and next of kin, hereby waives, releases, holds harmless, and indemnifies Sound Excursions, LLC d/b/a SE Productions, its owners, operators, instructors, officers, members, directors, and employees, agents, servants and affiliates (collectively, the “Released Parties”) from and against any and all actual or alleged injuries, liabilities, or damages related to participation in the Event and/or Activity, whether caused by the negligence of Released Parties or otherwise.

  1. 8.Participant additionally agrees to indemnify, hold harmless, and defend the Released Parties for, from, and against any defense, losses, costs or expenses arising from or related to any and all actual or alleged claims, injuries, liabilities, or damages related to participation in the Event and/or Activity, whether caused by the negligence of Released Parties or otherwise.

  1. 9.Participant understands that participation in the Event and/or Activity constitutes Participant’s consent for Sound Excursions, LLC d/b/a SE Productions, to use any film, video, or likeness of Participant for any legal purpose whatsoever, without payment or other consideration. Participant hereby authorizes Sound Excursions, LLC d/b/a SE Productions to take, edit, alter, copy, exhibit, publish, distribute and make use of any and all photographs, videos, and other media taken or created by Sound Excursions, LLC d/b/a SE Productions (collectively, “Media”). Participant hereby grants Sound Excursions, LLC d/b/a SE Productions the right to use any Media in and/or for any lawful promotional materials, including but not limited to, newsletters, flyers, posters, brochures, advertisements, fundraising letters, annual reports, press kits and submissions to journalists, websites, social networking sites and other print and digital communications.

  1. 10.The invalidity or unenforceability of any provision of this Agreement shall not affect the validity or enforceability of any other provision of this Agreement, which shall remain in full force and effect.

  1. 11.The validity, construction and enforceability of this Agreement shall be governed in all respects by the laws of the State of Washington and the parties hereto expressly agree that any dispute requiring resolution by a court shall be subject to the exclusive venue and jurisdiction of the state and federal courts located in Washington.

  1. 12.In the event of an injury, accident or emergency, Participant hereby authorizes Organizer personnel to take whatever action which, in their sole and absolute discretion, is most appropriate to respond to such an event, including but not limited to contacting emergency services to provide medical treatment and/or transport Participant for medical treatment. Participant hereby acknowledges and agrees that Participant shall be solely responsible for all emergency, medical, or other expenses which may be incurred as a result of any injury sustained as a result of participation in the Event and/or Activity.

  1. 13.By signing this Agreement, Participant acknowledges that Participant is voluntarily giving up important legal rights and that if anyone is hurt or property is damaged as a result of participation in the Event and/or Activity, Participant may be found by a court, meditator, or arbitrator to have waived the right(s) to maintain a lawsuit or pursue damages on Participant’s own behalf against the Released Parties for any claim from which Participant may have released them in this Agreement.

  1. 14. Participant has read and voluntarily signed this Agreement and has been given the opportunity to speak with a representative of Organizer before signing this Agreement and further agrees that no oral representations, statements, or inducement apart from the foregoing written Agreement have been made.
